These terms apply to your use of consolflora.com, run by Consolflora Ltd, Tumaini Estate, Nairobi, Kenya. By using the website you accept them. If you do not accept them, please do not use the website.
1. Who the website is for
The website is for businesses in the flower trade: buyers, growers and partners. It shows our services and flower catalogue. It does not take orders or payments itself.
2. Information on the website
We take care to keep the information accurate, but it is general information about our business and services. It is not an offer. Product availability, varieties, stem lengths, prices, volumes and delivery terms, including everything shown in the flower catalogue, are confirmed only in writing for each order. Photographs and illustrations are for illustration and may not show the exact products, varieties or farms.
3. Appointment requests and enquiries
Sending an appointment request or an email does not create a contract and is free of charge. A meeting is arranged only when we confirm a time with you. How we handle the information you send is explained in our Privacy Policy.
4. Orders and trade
Orders for flowers and our services are made under a written agreement or order confirmation between you and Consolflora. Those documents, and not this website, set the price, payment terms, delivery terms and other conditions of the trade. If they conflict with these terms, they take priority.
Wholesale buyers can open an account on our ordering platform through a link on the catalogue page. Opening and using an account, placing orders and paying for them happen on that platform and are governed by the terms shown there. New accounts trade on a prepaid basis, which means you pay before the flowers ship, unless we agree otherwise in writing.
5. Claims and refunds
- The website itself takes no payments, so there is nothing to refund through the website. Payments for orders are made on our ordering platform, and any refund follows the terms shown there and the order confirmation.
- Quality claims, credits and refunds on a shipment are handled under the written agreement or order confirmation for that shipment.
- If you have a concern about a shipment, tell us as soon as you can. Email info@consolflora.com with your name, the shipment details and photographs if you have them, and we will process and facilitate the claim with the growers involved, as part of our sourcing service.
- Nothing in these terms limits any right you have under the law that cannot be limited by agreement.
6. Intellectual property
The Consolflora name, logo, text, design and other material on the website belong to Consolflora Ltd or its licensors. You may view and print pages for your own business use. Please do not copy, change or reuse our logo or content without our written permission.
7. Using the website properly
Please use the website lawfully. Do not try to disrupt it, gain unauthorised access to it, send automated or spam submissions through the form, or submit information about other people without their permission.
8. Links to other sites
Links to other websites are given for convenience. We do not control those sites and are not responsible for their content.
9. Our responsibility
We provide the website “as is” and do not promise that it will always be available or free of errors. To the extent the law allows, we are not responsible for indirect or consequential loss arising from your use of the website. Nothing in these terms excludes or limits liability for fraud, for death or personal injury caused by negligence, or for anything else that the law does not allow us to exclude.
10. Governing law
These terms are governed by the laws of Kenya, and the courts of Kenya have jurisdiction over any dispute about them. This does not remove any mandatory protection you have under the law of the country where you live.
11. Changes
We may update these terms. The version on this page, with the date at the top, is the one that applies.
